Terms of Service

The agreement between you and WebScrap for the use of the web scraping API. Plain sentences, in the order the questions usually arrive.

Who these terms are between

These terms are between you, or the company you represent, and WebScrap, the operator of the service at webscrap.com. By creating an account or sending a request to the API you accept them. If you accept on behalf of a company, you confirm that you may bind it.

What we provide

WebScrap fetches public web pages on your instruction, through rotating proxies, rendering them in a browser where needed, and returns the response together with the fields defined by the extraction schema you sent. The functional description on this website forms part of these terms.

We may improve, change or retire individual features. Where a change removes something you rely on, we give at least 30 days notice by email to account holders.

Accounts, keys and team members

  • You keep your API keys secret and are responsible for requests made with them.
  • You tell us promptly if a key is exposed, and you can revoke and reissue keys yourself at any moment.
  • Team members you invite act under your account and you remain responsible for what they do with it.
  • The email address on the account is where every notice from us is sent.

How billing works

  • Every plan is a subscription, charged monthly or yearly in advance, and renews automatically until you cancel.
  • Prices are those published on the best web scraping api pricing page at the time of purchase, in US dollars and exclusive of any tax that applies where you are.
  • A plan includes a limit of successful requests per month. Only responses with a 2xx status count against it. The counter resets at the start of each billing period and unused requests do not carry over.
  • Requests above your limit return a quota error rather than an extra charge. You may move to a higher plan at any time and the difference is prorated.
  • If a payment fails we retry, and we email you before access is suspended.

Cancellation and refunds

You cancel at any time from the billing page in your account. The plan keeps working until the end of the period you already paid for, and nothing further is charged. Payments already made for a completed period are not refunded, except where the law requires it or where we failed to deliver the service.

Renewals and failed payments. Your subscription renews automatically until you cancel it. When a new billing period begins, access for that whole period is granted and the payment for it is due. If the charge does not go through, the payment remains due and we retry it. Cancelling after a new period has begun only switches off later renewals; it does not cancel the payment for the period that has already started. Such a renewal charge is not refundable, and your access continues until the end of that paid period. The fee is for access to the service for the period, not for using it, so not having used the service is not a ground for a refund.

What you must not do with the API

  • Do not request pages that require credentials, bypass authentication or access anything not publicly available.
  • Do not use the service to collect data in breach of the law that applies to you, including data protection, copyright and trade secret law.
  • Do not send volume calculated to disrupt a target site rather than to collect data from it.
  • Do not resell raw access to the API as if it were your own scraping service, unless we agree that in writing.
  • Do not attempt to circumvent request limits, rate limits or the technical controls of the service.

You are responsible for the legality of what you collect and what you do with it afterwards. The background on the limits of that is on the data scraping FAQ page and in is web scraping legal, and neither of those is legal advice.

If use breaches this section we may suspend the account, and we tell you why as soon as we can.

Ownership

The data returned to you through the API is yours. We process responses as your processor, hold them for the retention window of your plan and delete them afterwards, as described in the privacy policy.

The service itself, including the software, documentation and brand, remains ours. Nothing here transfers it to you.

What we commit to and what we do not

Scale carries a 99.9 percent uptime commitment with a four business hour response time. Enterprise adds an SLA with service credits. On other plans we run the same infrastructure without a contractual uptime figure.

Apart from those commitments the service is provided as it is. We do not warrant that a specific target site will remain reachable, that its layout will not change or that a particular page will return the fields you expect.

To the extent the law allows, our total liability in any twelve month period is limited to the amount you paid us in that period, and we are not liable for lost profit, lost data or indirect damage. Nothing here limits liability that cannot be limited.

Changes to these terms

We may update these terms. Material changes are emailed to account holders at least 30 days before they take effect, and continued use after that date means you accept them. If you do not, you may cancel and we refund the unused part of a prepaid period.

Governing law

These terms are governed by the law of the place where the service is operated, and disputes go to the courts competent there. Where you are a consumer, the mandatory protections of your country of residence still apply.
